Force Majeure Clause
A planned schedule/itinerary will be sent to you with your receipt upon booking or latest 30 days prior to departure. The itinerary may be subject to change due to circumstances beyond our control such as weather, late arrival of aircraft etc. or the order in which we view sites.
Door-to-door transportation, all entrance fees and fares for items on the itinerary, background and historical information on the day’s attractions and a knowledgeable and friendly driver/guide.
20% Down Payment is due at the time of booking. Balance (Payment in Full) is due three weeks prior to the tour or by the date listed on the confirmation/invoice. Payment in Full may also be made at time of booking. Payments can be made by credit card (Visa, MasterCard, AMEX), PayPal or bank transfer. Balance payments may be automatically settled, where possible, by using the same payment method as the deposit, unless the traveler specifically indicates otherwise in writing. Special Offers may have different payment terms.
Our prices are set in Euros but we can bill US residents in US dollars if desired. The traveler is guaranteed the US dollar tour price set at the time of down payment unless the US$/Euro exchange rate varies over 5% before the balance payment is made. Neither party should be required to take a hit if the 5% threshold is reached in the current climate of financial instability, so the remaining balance will be adjusted per se. This may mean a lower US$ price, or may lead to a surcharge.
The 20% deposit is non-refundable except under the following conditions: (1) You find a person to replace you on the tour, or (2) The deposit is transferred to a future tour, or (3) certain conditions of Force Majeur (like the pandemic); see below). The following charges apply if a cancellation is made three weeks or less prior to departure (percentage of total tour price):
21+ days prior to departure: 20%
11 – 20 days prior to departure: 50%
10 days or less prior to departure or no-show: 100% / No Refund.
Bavarian Day Tours acts as a tour operator. The suppliers providing inside sightseeing tours for the attractions are employees of the attraction or independent contractors and are not agents or employees of Bavarian Day Tours.
Bavarian Day Tours and their suppliers contracted for services reserve the right to refuse to accept or retain any person whose behavior is deemed likely to affect the smooth operations of a tour, or adversely affect the enjoyment or safety of other passengers or visitors to the attraction. Bavarian Day Tours, it’s agents, and suppliers shall be under no liability to any such person for refund, compensation, repatriation or any other matters arising from such behavior. Bavarian Day Tours is not responsible for circumstances beyond it’s control forcing trip cancellation or the inability for trip to depart as scheduled, such as acts of war and/or terrorism, war, or nature.
Be clearly advised that from time to time a tour departure may have to be canceled due to sudden illness or such. In such case, the operator’s sole responsibility is to provide a full refund.
Cancellations due to governmental travel advisories or warnings, acts of war, terrorism, or natural disasters or any other circumstance outside the control of Bavarian Day Tours, and are not the fault of Bavarian Day Tours may not be eligible for a refund. In these situations Bavarian Day Tours will endeavor to honor the tour at a later date.
The operators shall not be liable or responsible for failure or delay in fulfilling or performing any obligations under the current Terms and Conditions when such failure or delay is caused by or results from causes beyond the reasonable control of the operators. This includes, but is not limited to, disasters, civil unrest, labor disturbances, Government restrictions, including those as during the Coronavirus pandemic, such as quarantine measures and travel restrictions.
Should a Force Majeure event occur and we are unable to perform our duties, we will issue a Force Majeure credit for existing bookings. The credit can be in the form of a refund or applied towards a rescheduled or other future tour.
